This order requires a person to refrain from behaving in a certain manner which can cause you fear, alarm or distress. The behaviour can include uttering threats of violence, physical and verbal abuse. A Power of Arrest can be attached to the Interdict Order. The Power of Arrest allows the abuser to be arrested without the necessity of a warrant.
This order specifically deals with behaviour which causes distress and upset. There is no statutory definition of harassment. Therefore, this order can be obtained in a number of situations, for example, stalking, abusive and persistent phone calls and SMS messages and loitering. There is a strict test which requires to be met before a Non-harassment Order will be granted. A breach of the Non-harassment Order carries with it criminal penalties.
Spouses and Civil Partners have occupancy rights in the marital home by virtue of the marriage or Civil Partnership. The Exclusion Order is used to suspend the occupancy rights. The Courts will usually grant the Exclusion Order where your safety or the safety of your family is in question. The test for obtaining the Exclusion Order is quite strict and specific documentation will require to be produced for the Court.
