What we offer

MBS Solicitors have assisted firms all around the UK on an agency basis. We are regularly instructed to undertake agency work in the Immigration Tribunals, Sheriff Court, Sheriff Appeal Court, Court of Session and Supreme Court. We understand that principal agents may want to retain differing proportions of involvement in cases and so we offer a flexible approach to agency work.

Instructing Edinburgh Agents is a useful and productive option for those firms based outside of Edinburgh to avoid unnecessary travel and also for those firms who prefer the day to day administrative procedures to be carried out by an external firm.

For Sheriff Court appearances, our team is able to provide fixed fee quotes for routine work such as Procedural Hearings, Opposed Motions, Peremptory Diets, Child Welfare Hearings, Intermediate Diets as well as First Diets and Preliminary Hearings for the High Court. We are also available to be instructed for more substantive appearances including Debates, Proofs and Trials (summary and solemn cases). Our work also includes agency representation at Children’s Panels, Children’s Referral Proofs and the Mental Health Tribunal for Scotland.

For work in the Immigration Tribunal, our team is regularly instructed by English and Scottish law firms to appear for bail applications, appeals to the First-Tier Tribunal and appeals in the Upper Tribunal. We are also able to prepare notes of arguments and grounds of appeals as well as Pre-Action Protocol Letters before the commencement of Judicial Review proceedings.

The majority of our agency work arises in the Court of Session (Outer House and Inner House) where we have built up an established practice. We regularly instruct both Senior and Junior Counsel across a variety of areas of practice at first instance and on appeal. We are happy to tailor our approach to your requirements.

At the lowest level, we offer a “post-box” service where we manage the day to day administrative work of the Court of Session, offer timetable management and court running. This includes preparing and lodging processes for all types of actions, enrolling motions, preparing and lodging productions, arranging hearings, marking appeals etc. However, more commonly, we provide the traditional “Edinburgh Agent” service where we can instruct Counsel, attend consultations and appear at hearings.

We are also able to alleviate the burden of taking statements with our precognition services. Our team has extensive experience of precognosing witnesses across a wide variety of matters. We approach every case with sensitivity.
