Unmarried cohabitants (same sex or opposite sex) now have limited protection afforded by the Family Law (Scotland) Act 2006.  Unmarried partners are now able to make certain financial claims in the event of the relationship breaking down or the death of the other partner (in the absence of a Will).  The Law provides for any property (except money, cars, pets, gifts, inherited property) as being owned equally by the parties upon the breakdown of the relationship.  The Law provides that any savings (or property acquired through such savings), regardless of who contributed towards the savings, is to be owned equally.  However, this rule does not apply to the principal family home.  There is no provision for making of a transfer of property order or an obligation to pay maintenance to your cohabiting partner.

Where your partner has died, your rights will depend on whether your late partner made a Will or not.  If there is a valid Will the Family Law Act 2006 will not apply. The Courts in Scotland focus on dividing matrimonial property fairly. Interdict Order

This order requires a person to refrain from behaving in a certain manner which can cause you fear, alarm or distress. The behaviour can include uttering threats of violence, physical and verbal abuse. A Power of Arrest can be attached to the Interdict Order. The Power of Arrest allows the abuser to be arrested without the necessity of a warrant.

Non-harassment Order

This order specifically deals with behaviour which causes distress and upset. There is no statutory definition of harassment. Therefore, this order can be obtained in a number of situations, for example, stalking, abusive and persistent phone calls and SMS messages and loitering. There is a strict test which requires to be met before a Non-harassment Order will be granted. A breach of the Non-harassment Order carries with it criminal penalties.

Exclusion Order

Spouses and Civil Partners have occupancy rights in the marital home by virtue of the marriage or Civil Partnership. The Exclusion Order is used to suspend the occupancy rights. The Courts will usually grant the Exclusion Order where your safety or the safety of your family is in question. The test for obtaining the Exclusion Order is quite strict and specific documentation will require to be produced for the Court.

You can put a stop to the violence and intimidation immediately. The process commences with an Interim Order which can be obtained after the initial hearing without the other party being present. The Interim Order can provide the requisite protection until the Full Order is obtained.
